Disclaimer for Fleet CNX Motorbike Rental Services
This disclaimer ("Disclaimer") is applicable to all customers of Fleet CNX's motorbike rental services. Please read it carefully before agreeing to our Terms & Conditions and using our services.
1. Use at Your Own Risk
Every customer who rents a motorbike from Fleet CNX does so entirely at their own risk and assumes full responsibility for any risks, injuries, or damages, known or unknown, arising from their use of the rented motorbike. This assumption of risk does not extend to loss, injury, or damage caused by Fleet CNX's own fraud, willful misconduct, or gross negligence, liability for which cannot be excluded under Section 373 of the Civil and Commercial Code of Thailand.
2. Insurance Limitations & Subrogation
Fleet CNX provides the legally required compulsory motor insurance (Por Ror Bor), covering bodily injury, loss of life, or permanent disability up to the limits mandated by Thai law. This insurance does not cover damage to the rented motorbike or third-party property damage; customers are fully responsible for any damage to the vehicle. Under Thai law, injured third parties remain entitled to statutory compensation regardless of the driver's licensing status. However, if a customer operates the motorbike without a valid Thai Motorcycle License or an applicable International Driving Permit (IDP), the insurer and/or Fleet CNX may recover from the customer, by subrogation or direct claim, the full amount of any compensation, medical expenses, or damages paid out as a result of an accident occurring during such unlicensed use. We strongly recommend all customers carry personal comprehensive travel and health insurance.
3. Condition of Motorbikes
Fleet CNX ensures that all rented motorbikes are provided in a safe, roadworthy condition and fit for use at the start of the rental period. However, Fleet CNX does not guarantee the uninterrupted mechanical availability of the motorbike during the rental period, as unexpected issues such as flat tires or minor mechanical faults may occur during normal operation.
4. Indemnity
The customer agrees to indemnify, defend, and hold harmless Fleet CNX Co., Ltd., its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorney fees) arising from the customer's (or anyone using the motorbike with the customer's permission) use of our motorbikes, except to the extent such claims or liabilities are caused by the fraud, willful misconduct, or gross negligence of Fleet CNX, liability for which cannot be excluded under Section 373 of the Civil and Commercial Code of Thailand.
5. Road Safety & Legal Compliance
Fleet CNX is not responsible for any violation of Thai Land Traffic laws and regulations committed by the customer. The customer is strictly and solely liable for the payment of all traffic fines, administrative penalties, and vehicle impoundment fees resulting from their use of the motorbike.
6. Acknowledgment
By using our services, you acknowledge that you have read this Disclaimer, understood its terms, and agree to be bound by them. If you do not agree with or you are not comfortable with any aspect of this Disclaimer, you should immediately discontinue the use of our services.
